Mr. Kirsch has drafted numerous United States Patent Applications in fields ranging from medical devices to nautical safety devices. Additionally, Mr. Kirsch has analyzed existing United States Patents and Published United States Patent Applications to draft patentability opinions as well as freedom to operate opinions.

Mr. Kirsch has personally worked on over 150 federal trademark applications for companies ranging from "mom and pop start ups" to multi-national corporations. In his trademark practice, Mr. Kirsch has become familiar with the common rejections issued by Examining Attorneys during trademark prosecution; moreover, Mr. Kirsch has successfully argued against and overcome refusals issued against many of his client's trademark applications. Mr. Kirsch has developed the art of skillfully crafting legal arguments in response to the various issues that may be raised by the Examining Attorney throughout the registration process and he continues to perfect his art as Trademark Law continues to evolve.
